Paddles Up — Terms of Use

Effective: July 28, 2026

Welcome to Paddles Up, operated by Dawson Hanks ("we," "us," or "our"). By creating an account or using the Paddles Up mobile application ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information when creating your profile. We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Conduct — Zero-Tolerance Policy

Paddles Up has a zero-tolerance policy for objectionable content and abusive behavior. You agree not to:

• Post, send, or share content that is defamatory, obscene, threatening, harassing, hateful, discriminatory, or otherwise objectionable.
• Harass, bully, stalk, intimidate, or threaten any other user.
• Impersonate another person or misrepresent your identity or affiliation.
• Use the App for any unlawful purpose or to solicit others to perform unlawful acts.
• Upload viruses, malware, or any code intended to disrupt or damage the App.
• Scrape, crawl, or collect data from the App by automated means without our written consent.
• Circumvent any content-moderation, reporting, or blocking features.

We may remove objectionable content and terminate offending accounts at our sole discretion, without prior notice. Users can report objectionable content or behavior directly within the App, and we will act on reports within 24 hours.

4. User-Generated Content

You retain ownership of content you create (profile information, court reviews, photos, messages). By posting content through the App, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and store that content as necessary to operate the App. We do not claim ownership of your content.

5. Court Availability Data

Court availability information is provided for convenience and may be based on crowdsourced reports or sensor data. We do not guarantee its accuracy. Actual court availability may differ. Always confirm availability on-site.

6. Intellectual Property

The App, its design, features, and branding are owned by Dawson Hanks and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described there.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by law, Dawson Hanks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

10. Account Deletion

You may delete your account at any time from within the App. Upon deletion, we will permanently remove your personal data in accordance with our Privacy Policy. Some anonymized or aggregated data (such as historical court-usage statistics) may be retained.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
